General Terms and Conditions
1. Scope
These general terms and conditions (AEB) apply to all orders placed by customers via the online shop of www.shoppy-berger.ch, Hohenrainstrasse 24a, 4133 Pratteln (Switzerland), email; info@shoppy-berger.ch, UID: CHE-405.206.752 (seller).
By checking the the box in your shopping cart before completing your order, you confirm that you have read the terms and conditions used and agree to their validity. Deviating conditions require express written feedback from the seller.
The General Terms and Conditions apply in the version valid at the time the contract is concluded.
The seller reserves the right to update these terms and conditions at any time. By using the online shop, the customer accepts the currently valid version of the General Terms and Conditions.
2. Offer and conclusion of contract
2.1 The presentation of the products on www.shoppy-berger.ch does not constitute a legally binding offer, but rather an invitation to the customer to place a binding order (offer to conclude a contract).
2.2 By clicking on the “order with payment” order button, the customer places a binding order for the products listed on the order page.#
2.3 Immediately after receiving the order, shoppy-berger sends the corresponding invoice and bank details to the buyer by email. The purchase contract is only concluded after receipt of payment and subsequent order confirmation (shipping confirmation) by email.
3. Return Police
3.1 Due to hygiene reasons and safety concerns, the return of opened food and drinks of any kind is not permitted. For all other goods, customers have the right to return the goods free of charge within 14 days of delivery of the goods. The right of return is exercised by returning the goods; a corresponding complaint report with reasons is required by email to info@shoppy-berger.ch. The return must be made to shoppy-berger, Hohenrainstrasse 24, CH-4133 Pratteln.
3.2 The exercise of the right of return leads to the conversion of the purchase contract into a reversal relationship, according to which the services received under the purchase contract must be reimbursed. The enclosed return label must be used to return the item free of charge. The return label must be visibly attached to the package and posted at your nearest post office. The right of return does not apply when purchasing gift vouchers or foods if they are already stored in the user account.
3.3 After receipt of the goods, the purchase price already paid will be immediately refunded to the customer.
3.4 A deduction of the purchase price to be refunded remains reserved. an invoice for possible damage, excessive wear and tear of the goods or, if agreed, a different delivery address from the billing address of the goods. No deduction will be made if the loss in value is due to the handling of the goods that is necessary to determine the type, quality and functionality of the goods. shoppy-berger can refuse repayment until it has received the goods back or until the customer has provided proof that he has sent the goods back, whichever is earlier.
4. Price and shipping costs
4.1 The prices stated on the product page are net and include statutory value added tax (VAT) and other price components and are in Swiss francs (CHF) or EUR.
4.2 In addition to the stated prices, shipping costs may apply depending on the delivery address, quantity of goods and item. The exact shipping costs are displayed to the customer during the ordering process. There are no further costs for delivery within Switzerland. Depending on the value of the goods, additional customs costs may be incurred for shipments to the EU.
4.3 The seller reserves the right to change prices at any time. The prices published in the online shop on the order date apply to customers.
5. Delivery Terms and Conditions
5.1 By confirming the order button, the customer places a binding order for the products listed on the order page. The purchase contract is only concluded if the order is expressly confirmed by the seller. For online orders, confirmation is sent by email. Orders are generally only delivered after full payment has been received. Products delivered to the customer remain the property of the seller until full payment has been made.
5.2 If not all ordered products are in stock, shoppy-berger is entitled to make partial deliveries. The customer does not incur any additional costs due to partial deliveries.
5.3 The seller is not liable for delivery delays caused by manufacturing companies, the shipping service provider or third parties. If the seller is aware of any delivery delays, the customer will be informed immediately. When the goods are handed over to the shipping service provider, the benefit and risk are transferred to the customer - to the extent permitted by law.
6. Payment Conditions
6.1 At shoppy-berger, payment is generally possible by bank transfer, TWINT, credit card: Visa, Matercard, American Express in advance.
6.2 If you choose the payment method in advance, shoppy-berger will provide your bank details in the order confirmation. The invoice amount must be transferred to the shoppy-berger bank account within 10 days. If an order is not paid after this deadline, shoppy-berger reserves the right to cancel the order.
6.3 When paying by credit card, the customer's account is debited when the order is completed. A reservation of the order value is made at the time of the order.
6.4 Offsetting against unrecognized or not legally established counterclaims from the customer is excluded.
6.5 The customer can only exercise a right of retention if the claims are based on the same contractual relationship.
7. Reservation of Ownership
The goods remain the property of shoppy-berger until full payment has been made. Before transfer of ownership, pledging, transfer by way of security, processing or transformation is not permitted without the consent of shoppy-berger.
8. Warrenty
8.1 The Seller shall endeavor to deliver goods in perfect quality. Excluded from the warranty are damages that are not demonstrably due to poor quality of the products, defective packaging or other reasons for which the seller is not responsible.
8.2 In the event of defects notified in due time, the Seller shall assume the warranty. This is done at the discretion of the seller by equivalent replacement or by refunding the purchase price. Further claims are excluded. Any products returned by the customer shall become the property of the seller again.
8.3 If the subsequent delivery fails in the case of significant defects, the customer is entitled to withdraw from the contract.
8.4 Compensation for any further damage is excluded, in particular any liability for indirect damage and consequential damage caused by defects is excluded to the extent permitted by law.
8.5 The customer is obliged to inspect the delivered products immediately upon receipt of the delivery and to notify the seller immediately in writing (letter or email) of any detected defects. If the customer fails to do so, the products shall be deemed free of defects and approved.
8.6 Defects which were not recognizable during proper inspection shall be notified to the Seller in writing (letter or e-mail) without undue delay after their discovery, otherwise the Products shall be deemed accepted also with regard to such defects.
9. Liability
To the extent permitted by law, shoppy-berger excludes any liability for the products sold and delivered as well as for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes.
10. Privacy
When processing customer data, shoppy-berger undertakes to comply with the requirements of data protection law. 11. Closing Provisions
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant legal provisions shall apply. The legal basis and applications for this can be found in the Code of Obligations (OR).
